Cost Benefits of the Separation Package

The Legal Costs of Separation
  1. Legal Consultation:  If you were to meet with a lawyer for a one-hour legal consultation to help you understand your legal rights and to find out what you should do next, you would be charged approximately $400.00.
     
  2. Separation Agreement:  If you hired a lawyer to prepare a separation agreement for you and provide independent legal advice for you (assuming your spouse agrees with everything that you want incorporated in the agreement), it would cost you approximately $2,500.00.
     
  3. Uncontested Divorce:  If you hired a lawyer to get you an uncontested divorce, which is a divorce for you and your spouse without either of you disputing the issues that you may have with each other, it would cost you approximately $2,500.00.
     
  4. 4-way Meeting:  If you hired a lawyer to represent you in a half-day settlement meeting with your spouse and his or her lawyer, it would cost you approximately $5,000.00.
     
  5. Litigating your case:  If you hired a lawyer to litigate your case - which includes correspondence with your spouse's lawyer, attending conferences, attending 4-way meetings, drafting minutes of settlement and processing your divorce, it would cost you anywhere between $10,000.00 and $50,000.00 and usually, your level of service will be proportionate to the amount that you spend.
     
  6. Summary: It would not be considered unusual for Family Law Proceedings to range in costs from $5,000 to in excess of $50,000.
